I hereby personally declare my voluntary decision to participate in all of the football activities and /or events organized by the Mons Calpe Sports Club Limited (the “Club”) anywhere in the world. declaro personalmente mi decisión voluntaria de participar en todas las actividades y/o eventos de futbol organizados por Mons Calpe Sports Club Limited (el “Club”) en cualquier parte del mundo (the “Events”) (los “Eventos”). And as such, I hereby fully acknowledge that the Events, are sporting events and as any sporting events are an extreme test of a person’s physical and mental limits that has many risks such as, but not limited to, physical exertion, falls, bodily injury, muscle injuries, broken bones, contact with other participants, exposure to contagious factors, elements, diseases and viruses, including COVID19 and any of its variants, and including death and personal property loss. I also recognize that I may be asked to practice for, participate in, and travel to and from different venues to participate in the Events, I therefore HEREBY EXPRESSLY ASSUME THE RISK OF PARTICIPATION IN THE EVENTS. Y como tal, por la presente reconozco plenamente que los Eventos están relacionados con el la práctica deportiva y, como cualquier evento deportivo, son una prueba extrema de los límites físicos y mentales de una persona y que tienen muchos riesgos como, lo son entre otros, el esfuerzo físico, caídas, lesiones corporales, lesiones musculares, fracturas de huesos, contacto con otros participantes, exposición a factores, elementos, enfermedades y virus contagiosos, incluido el COVID19 y cualquiera de sus variantes, y que incluyen incluso la muerte y/o la pérdida de propiedad personal o privada. También reconozco que se me puede pedir que practique, participe y viaje hacia y desde diferentes lugares para participar en los Eventos, por lo tanto, ASUMO AQUÍ DE MANERA EXPRESA EL RIESGO DE PARTICIPACIÓN EN LOS EVENTOS.

 

I therefore hereby personally and expressly take the following action on behalf of myself, my executors, administrators, heirs, next of kin, successors and assigns: Por lo tanto, por medio del presente tomo personal y expresamente la siguiente acción en mi nombre, así como en nombre de mis albaceas, administradores, herederos, familiares, sucesores y cesionarios:

 

a.I HEREBY EXPRESSLY FULLY WAVE, RELEASE, AND DISCHARGE from any and all claims or liabilities for death or personal injury or damages of any kind, which arise out of or relate to my participation in, or my traveling to and from the Events, the following persons or entities: Mons Calpe Sports Club LTD; and its parent, related, holding and/or affiliated companies, and their officers, directors, employees, agents, representatives, shareholders, sponsors, and the successors and assigns of each of the foregoing persons and/or entities, as well as to the Gibraltar Football Association and the Gibraltar Football League Association (the “Indemnified Parties”). YO POR MEDIO DE LA PRESENTE Y DE MANERA EXPRESA, RENUNCIO, LIBERO Y DESCARGO de todas y cualquiera reclamaciones o responsabilidades por muerte o daños en mi persona, personales o daños de cualquier tipo, que surjan de o se relacionen con mi participación en, o mi viaje a participar en los Eventos, a las siguientes personas o entidades: Mons Calpe Sports Club LTD; y sus empresas propietarias, controladores, matrices, relacionadas y/o afiliadas, y sus funcionarios, directores, empleados, agentes, representantes, accionistas, patrocinadores y los sucesores y cesionarios de cada una de las personas y/o entidades anteriores, así como a la Asociación de Fútbol de Gibraltar y la Asociación de la Liga de Fútbol de Gibraltar (las "Partes Indemnizadas").

 

1. I HEREBY EXPRESSLY AGREE NOT SUE nor bring any type of lawsuit, claim or dispute against any of the Indemnified Parties for any of the claims or liabilities that I have expressly waived, released or discharged herein; and YO POR MEDIO DE LA PRESENTE Y DE MANERA EXPRESA ACEPTO Y ACUERDO EN NO DEMANDAR ni presentar ningún tipo de demanda, reclamo o disputa contra ninguna de las Partes Indemnizadas por cualquiera de los reclamos o responsabilidades que he expresamente renunciado, liberado o descargado en este documento; y

 

1. I HEREBY EXPRESSLY AGREE TO INDEMNIFY AND HOLD HARMLESS the Indemnified Parties from any claims made or liabilities assessed against any of them as a result of my actions or my participation in the Events. YO POR MEDIO DE LA PRESENTE Y DE MANERA EXPRESA ACEPTO Y ACUERDO EN INDEMNIZAR Y SACAR A SALVO a las Partes Indemnizadas de cualquier reclamo hecho o responsabilidades aplicadas en su contra como resultado de mis acciones y/o mi participación en los Eventos                                                               

I hereby affirm that I am eighteen (18) years of age or older and I have read this document thoroughly, and I understand its contents agreeing to the Responsibility Statement and Liability Disclaimer set forth above. I understand that I have given up and have waived substantial rights by signing this document and I willingly sign it voluntarily. Por medio de la presente afirmo que tengo dieciocho (18) años de edad o más y que he leído este documento detenidamente y entiendo su contenido y estoy de acuerdo con la Declaración y el Descargo de Responsabilidades establecidos anteriormente. Entiendo que he renunciado a derechos sustanciales al firmar este documento y por lo tanto por mi propio derecho lo firmo voluntariamente.

 

Furthermore, I hereby expressly authorize the use, as well as irrevocably assign any copyright, or publication of my (and if applicable my child’s) name, image or voice as may be captured by photograph or video or sound recording while participating in the Events and related activities in any medium for any purpose, including illustration, promotion or advertisement of the Events, the Club, and/or the Club Sponsors of the Events, the Club or any of the Indemnified Parties. Además, autorizo de manera expresa el uso, así como cedo de manera irrevocable los derechos autorales y la publicación de la grabación de mi nombre, imagen o voz (y, si aplica la de mi hijo/a), según sea capturada por fotografía o vía grabación de audio o de video mientras participo en los Eventos y actividades relacionadas con los mismos, en cualquier medio para cualquier propósito, incluida la ilustración, promoción o publicidad de los Eventos, del Club, y/o de cualquiera de los patrocinadores de los Eventos o del Club, así como de cualquiera de las Partes Indemnizadas.

 

The foregoing release and indemnification agreement shall be as broad and inclusive as is permitted by the place in which the Events are conducted. If any portion of it is held invalid, the balance shall continue in full force and legal effect. I have read, understand and agree to the terms of this Agreement. El presente acuerdo de exención e indemnización será tan amplio e inclusivo como lo permita el lugar en el que se lleven a cabo los Eventos. Si alguna parte se considera inválida, el resto continuará con plena fuerza, vigor y efecto legal. He leído, entiendo y acepto los términos del presente Acuerdo.

 

This Agreement has been redacted and made in the English language and the English language shall control the meaning of the document. The Spanish version is only a courtesy translation without any legal effect. In case of dispute between terms, the English version shall control. El presente Contrato ha sido redactado en el idioma inglés, y será en todo momento el idioma inglés el que controle el significado del documento. La versión en español es meramente una traducción de cortesía sin efecto legal alguno. En caso de discrepancia entre los términos del mismo, la versión en inglés controlara.

 

This Agreement shall be governed by the laws of Gibraltar, and any legal action relating to or arising out of this Agreement shall be commenced exclusively in the courts located in Gibraltar. El presente Acuerdo se regirá por las leyes de Gibraltar, y cualquier acción legal relacionada con este Acuerdo o que surja de él se iniciará exclusivamente en los tribunales ubicados en Gibraltar.

(if the participant is under eighteen years of age, a parent or guardian must agree in addition to the above Declaration and Release of Liability, to accept this Minor Addendum on behalf of the minor. I hereby expressly agree to the forgoing Waiver and Release for and on behalf of my minor named herein. I hereby bind myself, the minor and all other assigns to the terms of the Waiver and Release. I represent that I have a legal capacity and authority to act for and on behalf of the minor in the execution of the Waiver and Release. I am the legal guardian of the participant, and I hereby consent to his/her participation in the Events. I have read and explained the foregoing release and indemnification agreement to my child, and I hereby agree to its terms on behalf of myself and the minor Participant. por medio del presente acepto expresamente la Renuncia y Exención anterior para y en nombre de mi menor mencionado en este documento. Por la presente me obligo a mí mismo, al menor y a todos los demás cesionarios a los términos de la Renuncia y Liberación del presente documento. Asimismo, declaro que tengo la capacidad legal y la autoridad para actuar por y en nombre del menor en la firma de la presente Renuncia y Liberación. Soy el tutor legal del participante y por la presente doy mi consentimiento para su participación en los Eventos. He leído y explicado el acuerdo de exención e indemnización anterior a mi hijo, y por la presente acepto sus términos en mi nombre y en el del menor Participante.

 

In consideration of my and/or my child’s participation in the Events, I agree to fully assume the risks incidental to such participation (which risks may include, among other things, muscle injuries and broken bones, as well as risk of contracting viruses and infectious diseases including COVID19, and including death) and, on my own or my child’s behalf, and on behalf of my and my child’s heirs, executors and administrators, release and forever discharge the Indemnified Parties, of and from all liabilities, claims, actions, damages, costs or expenses of any nature arising out of or in any way connected with my or my child’s participation in the Events, and further agree to indemnify and hold each of the released and Indemnified Parties harmless against any and all such liabilities, claims, actions, damages, costs or expenses, including, but not limited to, all attorney's fees and disbursements. En consideración a la participación mía y/o de mi hijo en los Eventos, acepto y asumo completamente los riesgos relacionados con dicha participación (los cuales pueden incluir, entre otras cosas, lesiones musculares y fracturas de huesos, así como el riesgo de contraer virus y enfermedades infecciosas, incluido COVID19, incluida la muerte) y, en mi nombre y en el de mi hijo, y en nombre de mis herederos, albaceas y administradores o de mi hijo, libero y eximo para siempre a las Partes Indemnizadas, de cualesquiera y todas las responsabilidades, reclamos, acciones, daños, costos o gastos de cualquier naturaleza que surjan de o estén relacionados de alguna manera con mi participación o la de mi hijo en los Eventos, y, además, estoy de acuerdo en indemnizar y a mantener a cada una de las Partes Indemnizadas y liberadas indemnes contra cualquier y todas esas responsabilidades, reclamaciones, acciones, daños, costos o gastos, incluidos, entre otros, todos los honorarios y desembolsos de abogados.

 

I understand that this release and indemnity agreement includes any claims based on the negligence, action or inaction of any of the above released Indemnified Parties and covers bodily injury (including death) and property damage, whether suffered by me or my child, before, during or after such participation in the Events. Entiendo que este acuerdo de exención e indemnización incluye cualquier reclamo basado en la negligencia, acción o inacción de cualquiera de las Partes Indemnizadas liberadas anteriormente y cubre lesiones corporales (incluida la muerte) y daños a la propiedad, ya sea que yo o mi hijo haya sufrido, antes, durante o después de dicha participación en los Eventos.

 

I declare that my child and I are physically fit and have the skill level required to participate in the Events. I further authorize medical treatment for my child, or myself at my cost and expense, if the need arises. I also understand that my child or I may be required to leave the Events should my child or I exhibit undesirable conduct at the Club’s discretion. Yo declaro que mi hijo y yo estamos en buena forma física y tenemos el nivel de habilidad requerido para participar en los Eventos. Además, autorizo el tratamiento médico para mi hijo, o para mí mismo, a mi costo y gasto, si surgiese la necesidad. También entiendo que mi hijo o yo podamos tener que abandonar los Eventos si se nos requiere, en el caso de que mi hijo o yo exhibiésemos una conducta indeseable, a la discreción del Club.

 

I hereby authorize any licensed physician, emergency medical technician, hospital or other medical or health care facility to treat the minor named herein or myself for the purpose of attempting to treat or relieve any injuries received by said minor arising out of, or relating to his/her or my participation in the Events. I authorize any such Medical Provider to perform all procedures deemed medical advisable. I realize and appreciate that there is a possibility of complications and unforeseen consequences in any medical treatment including death, and I fully assume any such risk, cost and expense involved for and on behalf of myself and said minor. Por la presente autorizo a cualquier médico con licencia, técnico médico de emergencia, hospital u otro centro médico o de atención médica a tratar al menor mencionado en este documento y/o a mí mismo con el fin de intentar tratar o aliviar cualquier lesión recibida por dicho menor o por mí que surja de o se relacione con su participación o la mía en los Eventos. Autorizo a dicho Proveedor médico a realizar todos los procedimientos que se consideren médicamente aconsejables. Me doy cuenta y aprecio que existe la posibilidad de complicaciones y consecuencias imprevistas en cualquier tratamiento médico, incluida la muerte, y asumo completamente cualquier responsabilidad, costo y gasto de riesgo involucrado para y en mi nombre y el del menor.

 

It is my responsibility to ensure that my child’s clothing and equipment are properly fitted and appropriate for use in the Events. I represent and warrant that my child is physically fit and able to participate in the Events. My child agrees to stop and request assistance if he/she experiences any symptoms such as, but not limited to, dizziness, excessive fatigue, shortness of breath, pain or any other conditions that would make it difficult or unsafe to continue. Es mi responsabilidad asegurarme de que la ropa y el equipo de mi hijo estén bien ajustados y sean apropiados para su uso en los Eventos. Declaro y garantizo que mi hijo está en buena forma física y puede participar en los Eventos. Mi hijo acepta detenerse y solicitar ayuda si experimenta algún síntoma como, entre otros, mareos, fatiga excesiva, dificultad para respirar, dolor o cualquier otra condición que pudiera dificultar o hacer inseguro continuar.

 

I agree, for myself, my heirs, executors and administrators, to not sue and to release, indemnify and hold harmless the Indemnified Parties form any and all liability, claims, demands, and causes of action whatsoever, arising out of my child’s participation in the Events and related activities whether it results from the negligence of any of any of the above or from any other cause. Furthermore, I authorize the use, exploitation, irrevocably assign any copyright and/or publication of my child’s name, image and/or voice as may be captured by photograph or recording while participating in the Events and related activities in any medium physical or digital, now known or thereafter developed for any purpose, including illustration, promotion or advertisement of the Events, the Club or any of its sponsors or the Indemnified Parties. Yo acuerdo y acepto, por mí mismo, mis herederos, albaceas y administradores, no demandar y liberar, indemnizar y eximir de responsabilidad a las Partes Indemnizadas de cualquier responsabilidad, reclamo, demanda y causa de acción de cualquier tipo que surja de la participación de mi hijo en los Eventos y las actividades relacionadas, ya sea que resulte de la negligencia de cualquiera de los anteriores o de cualquier otra causa. Además, autorizo el uso, explotación, y cedo de manera irrevocable los derechos autorales de registro y/o la publicación del nombre, imagen y/o voz de mi hijo, según se pueda capturar mediante fotografía o grabación mientras participa en los Eventos y actividades relacionadas en cualquier medio físico o digital ahora conocido o por desarrollarse en el futuro para cualquier propósito, incluida la ilustración, promoción o publicidad de los Eventos, del Club o cualquiera de sus patrocinadores o las Partes Indemnizadas.
